Michigan used to have a workers’ compensation system that worked for working people — delivering prompt benefits that compensated struggling families for their loved ones’ workplace injuries or tragic deaths. In exchange, workers gave up their rights to sue employers for negligence and unlimited damages.
But today, benefits are no longer quick, guaranteed, or enough to support a family because of bad court decisions and anti-worker laws passed during Republican Governor Rick Snyder’s time in office.
Insurance companies use an ridiculous provision known as “phantom wages” to lower workers’ comp benefits by guessing what the disabled worker should be able to should be able to make, even if they’ve been rejected from all positions they have applied for.
In Michigan, these relaxed workers’ compensation laws mean that insurance companies don’t pay their fair share to injured workers or the grieving families of workers killed on the job. Instead, these families face a mountain of outdated requirements, only to receive peanuts in return.
